I just don't see the reason it couldn't be grandfathered in. In any case where rules were made like this in previous roleplays, be them mine or someone else's, generally speaking they allow the first infarction and then enforce the rule, especially in a case where the structure for creation allowed for something that wasn't originally denied. It normally adds diversity in the fact that something exists that, due to the rules, will not exist otherwise.
