The McKenna's no longer hold any power in Justice. When Scott retired to Texas, he signed everything over to the state and through that, the DiAngelo's took over and when they left, the Jagiekski's claimed power. If Scott were to return, he'd have to make a hell of a fight to get his power back, if not it's better left his return is just a cameo.
