I am so angry right now, my Cousin and his friends are getting harassed on twitter for using a name that someone has, but these people are saying they have a copyright(which they don't) and they are gonna sue them

So i have a question, do you guys think that someone can have a copyright without filing for one and yet using that in Court and saying "He had it first"
