They fired first, have ignored all attempts to estiblish a line of communication, and then fired on a Iscandarian ship after approaching atmosphere and ignoring warning shots.

Also Apollo, those fighters are using kinetic ordinance. As in rail-guns, how do you stop that with other kinetic weapons?
