So I suppose it's Lazarus own and final decision to get himself arrested or be on the run and probably get the other members of Phoenix Wing in danger.

Course the Fairy Tail members tried to fight them and ignored him anyhow until Erza went 'let him go' because it really would of got them in trouble if she didnt.
