Cause humans suck. All androids that are psychically indistinguishable from humans be they Cylons or human-form Replicators are extremely well disguised androids. That is like saying the sky is blue. Watching videos of her "birth" in a manufacturing plant tends to prove one is not human if one were inclined to believe that.
My basic argument is this: 1) All objects have critical properties and non-critical properties. 2) If all of two objects critical properties are identical, then they are both the same type of object. 3) "Indistinguishable by all means" means that everything that can be tested for, including all critical and non-critical properties, are identical to humans, or at least within acceptable range. If that is the case, then she is human. 4) If, instead, her critical properties weren't all identical to a humans, but she is disguising them somehow, then she could still be an android. 5) We know she has several properties which humans tend to not have, though they could be considered non-critical, as a cyborg could also be a human and have them. How is she made? Is she made of nanites? A skeleton, blood, and synthetic flesh? Nanite-constructed organic flesh? Whatever the method, there are likely discrepancies that can be located.
