Barring Obama nominating the ghost of Ronald Regan (which, let's be honest they'd be 70% likely to block that), looks like it. It's funny because when this happened in '68, it was to block Abe Fortas from going from associate justice to chief justice and replacing a retiring Earl Warren. Abe Fortas was shady as shit but Strom Thurmond (Who was born and raised thirty miles away from where I live) mostly raked him over the coals for his civil rights decisions and Jewish lineage. They didn't say that it wasn't right for lame duck LBJ (who decided not to seek reelection at that point) to nominate a candidate, even Thurmond recognized LBJ was within his right as president to nominate someone. Well, LBJ backed off, Warren waited until the new president took office to retire, and Fortas eventually resigned because of that flap. Nixon appointed Warren Burger. He and the justice that took Fortas' place ended up turning Roe V. Wade into a 7-2 decision instead of a much closer ruling.
