It's established at the beginning the area is in the tropics and the waters are warm, making it impossible for there to be any ice until [i]after[/i] the Leviathan uses its magic. And the ice before that was simply a burst of it as the Leviathan awoke. You could argue, however, Stark didn't take the time to see if Miyu was alive before firing?
