Mostly your opinion of him as an Aussie. To me the guy feels like a good man pushed to the edge to do bad things, while trying to keep his own morals. Still folk hero or not he was still a criminal. Even if the law was corrupt which did suck for them at the time.
One of the first things you realize when you look through Australian history is that no Saints exist. It's one of - in my opinion - the best things about Australian history. There's no "purity", or mythical good figures. Pretty much all the major figures have had varying degrees of scumbaggery to them and Kelly was no exception. Honestly, I view him pretty much as you described him... but with the addition of being a rural terrorist who wanted to shroud himself in a Robin Hood-esque mythology to maintain popular support. That said, the Commission which formed in his wake was extremely beneficial in reforming colonial Victorian police methodology... and even after their downfall there were threats of a repeated outbreak of similar outlaw behavior for the better part of a decade. Which mainly started to change when police started to take a different approach to selection-based relations (and dealt with issues viewing them more of matters of land rather than crime - so basically; empathy) I'm probably not the best person to talk to on the Kellys though, because I think they've been a bit oversaturated and glamourized (not unsurprisingly... again, wrapping themselves in myth was one of their main intentions) and viewed disproportionately compared with other aspects of our history that I find more interesting.
