But yes, you're right, an alternate Oliver Queen exists in this universe. But with all the money and lawyers at Bruce Wayne's disposal, especially following his inheritance of Luthor's fortune, Bruce had him legally resurrected and recognized as legal inheritor of the Queen fortune and name.

Much of this will be explained in History classes :P
