[@Omega Man] What's the rule on creating/using villains as PCs or NPCs?

Will we be able to play villains as a  secondary character?

What if Player A and Player B both want to claim the same villain as an NPC/Supporting Character? (For example: both Nightwing's player and Red Hood's player want to claim the Joker.)
