Each soul gem has it's only pocket dimension, big enough to fit a soul in. Morgan has a limited soul and once he consumes a soul the soul gem, or jolly rancher, would be emptied and he'd be able to obtain another soul. 

As for the near death thing, I would say that they would have to be very badly hurt, their internal organs damaged or not working. "Death is a condition, where the nervous system is inactive, the eyes closed, the postural muscles relaxed, and consciousness permanently suspended." Something like that. 

If the person is healing, I would say there would be some kind of resistant coming from the soul trying to hold on to it's living body and the spell could not work. Depending on how badly the other person would want to live. Like for the elderly and sick, it would be easier to get their soul since their state of mind wouldn't be so intact? So if someone else is healing the person who is near death it would be easier to get that person's soul than to get someone who is actively healing themselves.
