I asked permission for both since I knew they each had a less believable backstory. I have made a point of having all of the other characters I've made have backstories involving ONLY CHARACTERS I CREATED. I have carefully avoided looping in unmade characters or other people's characters. Read any of them. If it involves someone else, I asked permission and got it.
