I read your post and thought about it fro some time. It feels like there would, but I can't really think of anything at the moment of where is was mentioned or implied that someone was given a death penalty. I thought about the things that Jellal and the members Oracion Seis have done in their past, but they seem to just end up back behind bars. If they had the death penalty, then they probably wouldn't of been seen in the series again.

No, it doesn't.

Mostly, bad bad bad people are locked away in the magical dampening cells, although that doesn't mean that leaders don't have people killed. We've seen that nearly happen to the fairy tail group several times, after all.
