No, and it cannot happen again. We have learned much since Tier Five's implementation. I also highly recommend not performing System shifts rapidly in a short period of time. Or rapidly at all, given the undefined behavior of the System.

No, and we learned of their existence after it was too late to fix them prior to them being taken advantage of.
