At least I believe that's how it works. They never really gave THAT much insight on it. Doffy only got Ace's devil fruit because he has 'connections' and Blackbeard managed to get Whitebeard's because he was able to steal it from his dieing body...somehow.

There may be some means to extract someone's devil fruit from a dieing Devil Fruit user's corpse, but I don't think that's been shown yet.

While Carol ultimately didn't prove as a big a help as Eric had hoped, it was still better than nothing and he appreciated that she tried. As soon as she complained about burning up he quickly backed away from her. "Thanks for the help anyway and I'm sorry about your clothes."

After some focusing he managed to stop burning though switching between states still took a bit too long for him. It was at that time that he got an idea for training his powers that should be reasonably safe even with the others around. He decided to spend the rest of his time trying to speed that process up.

While he still refused to apologize for what he did he at least wanted to show that as far as he was concerned the fight was over.

He turned his back to the crocodile and began to walk away, certain that any student chosen by Master Po would never attack someone in the back without a very good reason no matter how angry they were.
