I'm working on a new constitution for Persia, and I have a question for all of you: what could be the possible implications of private property and inheritance not being a fundamental right guaranteed by the constitution? (you can understand why a Marxist Socialist Party would not want to sanctify property)

I don't think the right to private property is a thing on any constitution. I assume it's law that my property is my property and you can't take it off me but a constitution is more or less a list of shit that the government cannot infringe upon in any circumstances.

Our constitution is all about keeping the British out and reminding us to go to church. I don't think private property is a fundamental right in Ireland.

You're thinking of the Bill of Rights. A constitution is usually about how the government itself is to be organized and what its jurisdictions will be. Most of the US constitution is deciding what the president does, what the legislature does, and what the supreme court does. Even at its conception, the proposal to add a bill of rights was controversial. with the Federalists arguing that having the rights of the citizens listed implies that the listed rights are the only rights a citizen has, hence why the ninth amendment was tacked on.

Regarding Right to Property, Chapa is correct in saying that it isn't necessarily a fundamental right. If it were, imminent domain would not be possible. Other constitutions might, but I don't know much about it. You'd have to research how other communist states have struck down private property.

Actually I'm copying the current German constitution in that a bill of Basic rights is included within the Constitution, guaranteeing the fundamental rights that all citizens possess. I haven't had the time to explain it IC, but the Socialist Party does not have a stranglehold on power, and has to share it with a broad coalition of leftists, liberals, etc, who fear any attempt to establish a dictatorship. So the constitution will be the product of a compromise between all these factions, with the Socialists accepting a democratic framework (for the time being, at least in their mindset), and the others letting them make it very social-oriented.
And the thing is, the German constitution does guarantee property, and I could see why the liberals and farmers might want to enshrine this guarantee. Furthermore, Persia just avoided a civil war, and the conservatives are understandably always on the brink.

Perhaps the leftists could make an argument that enshrining private property would complicated certain government actions? Hell, maybe they could make the argument that such a right could make taxation legally problematic. I could simply be a matter of the left trying to weasel out of that right, or making sure the wording of it renders it impotent.

I could simply be a matter of the left trying to weasel out of that right, or making sure the wording of it renders it impotent.


In this case it would need to carefully define what could be called property, or else as you said taxation would become difficult if someone can declare money a piece of private property and can not be taken away. So there'd probably need to be something defining property as something akin to land and the ownership there-of, or even land capable of producing usable goods (defined as agriculture, mining, industry, etc. etc.) or possession of land that might otherwise generate revenue (which would be classified as its own thing so as to fully avoid confusion on if a dollar bill is the same as two-hundred acres of wheat fields or something).

Huh, it seems that not only did my recent videos I've been making get lost. Seems several drafts for four different RPs have been lost.(I've been wanting to redo a few of them but didn't want to start from the beginning again.) So, I have no choice but to restart my post. Again.
